  2. All the data represented on the website is of the parent company Servotech Power Systems Ltd.
  3. The website offers information about our business, including details about the locations of our EV charging stations and collaborations for installations across the country. Additionally, it provides a cloud-based ecosystem aimed at enhancing the EV charging network of Incharz. Furthermore, clients/customers can make payments for the services booked and utilized through the website.
  4. In order to promote the Website, content from other members may be displayed on various platforms, including other websites, applications, emails, and advertisements. The Website may also feature links to third-party websites or resources known as "Third-Party Services." These services may have their own terms and conditions and privacy practices, for which Incharz holds no responsibility or liability. Incharz does not guarantee the availability or accuracy of Third-Party Services, nor does it endorse the content or services provided by them.
  5. Due to the dynamic nature of the Internet, Incharz cannot guarantee the continuous and uninterrupted availability and accessibility of the Website. Incharz reserves the right to restrict access to the Website or certain features if necessary, such as due to capacity limits, server security, or for maintenance purposes aimed at ensuring proper functioning. Additionally, Incharz may periodically enhance, modify, or introduce new services to improve the overall user experience.
  6. Incharz reserves the right to impose specific conditions or requirements for accessing and using the Website, including certain areas or features. These conditions may include completing a verification process, which could be linked to your mobile phone or other verification methods.
  7. User verification on the Internet is challenging, and we do not take responsibility for confirming a user's identity. By continuing to access or use the Website, you acknowledge and agree that you accept the updated Terms.
  9. If you choose to register as a host or distributor on the Incharz website, separate terms and conditions will apply during the registration process. Upon creating an account, you are responsible for safeguarding the confidentiality and security of your User Account credentials. You must not disclose your credentials to any third party, as you are liable for all activities carried out through your User Account. Any payments received through your User Account will be deemed genuine and non-refundable by Incharz, absolving Incharz of responsibility for fraudulent charges.
  10. You acknowledge and agree that the Website and its content, including all associated intellectual property rights, belong exclusively to Incharz. You agree not to remove, alter, or obscure any copyright, trademark, service mark, or other proprietary rights notices displayed on or accompanying the Website. All trademarks, service marks, logos, trade names, and other identifiers associated with Statiq on or in connection with the Website are the property of Statiq. Any trademarks, service marks, logos, trade names, or other proprietary designations of third parties used on or in connection with the Website are for identification purposes only and may be the property of their respective owners.
  11. You are prohibited from using, copying, adapting, modifying, creating derivative works of, distributing, licensing, selling, transferring, publicly displaying, publicly performing, transmitting, broadcasting, or otherwise exploiting the Website. No licenses or rights are granted to you by implication or otherwise under any intellectual property rights owned or controlled by Servotech EV Infra Pvt. Ltd. or its licensors, except for the licenses and rights expressly granted in these Terms.
  12. Servotech EV Infra Pvt. Ltd. has partnered with Razorpay to enable the online payment facility on the Website. By making a payment on the Website, you agree to abide by the terms and conditions of the payment gateway, in addition to the terms stated herein.
  13. As a general policy, Incharz is not obligated to provide refunds for any consideration already paid by you. As a user, you have the option to leave a public review ("Review") and submit a star rating ("Rating") based on your experience with the Website, Services, and/or Vendors. It's important to note that Ratings and Reviews are not verified by the Website for accuracy and may be incorrect or misleading. However, Ratings and Reviews must be accurate and may not contain any offensive or defamatory language.
  14. You are solely responsible for complying with all laws, rules, regulations, and tax obligations applicable to your use of the Website. In connection with your use of the Website, you agree not to:

    Breach or circumvent any applicable laws, regulations, agreements with third parties, third-party rights, or our Terms and Conditions.

    Use, display, mirror, or frame the Website or any element within it, Incharz's name, trademarks, logos, or proprietary information, or the layout and design of any page, without Incharz's express written consent.

    Dilute, tarnish, or otherwise harm the Incharz brand, including through unauthorized use of Incharz's trademarks or similar identifiers.

    Use any automated means to access, collect data, or interact with the Website.

    Attempt to circumvent any technological measures implemented by Incharz or its providers to protect the Website.

    Take any action that damages or adversely affects the performance or functioning of the Website.

  15. Incharz reserves the right to immediately terminate this Agreement and/or deny access to the Website if:

    (i) You have materially breached your obligations under these Terms, the payment terms, or our Policies.

    (ii) You have violated applicable laws, regulations, or third-party rights.

    (iii) Incharz believes in good faith that such action is reasonably necessary to protect the personal safety or property of Incharz, its Website visitors, users, or clients.

  16. By using the Website, you acknowledge and accept that you do so voluntarily and at your own risk. The Website is provided "as is," without any warranty of any kind, whether express or implied. As a user of the Website, you agree to always provide accurate and truthful information about yourself. You understand and agree that Incharz assumes no responsibility for the accuracy or reliability of the information provided by you
  17. The user is solely responsible for checking and ensuring the availability of EV charging stations. If identity verification or background checks are conducted on any user, we do not warrant, either expressly or impliedly, that such checks will identify prior misconduct or guarantee future behavior. You bear full responsibility for the decisions you make before, during, and after using the Website.
  18. The disclaimers mentioned above apply to the fullest extent permitted by law. You may have additional statutory rights, but any statutorily required warranties, if applicable, will be limited to the maximum extent permitted by law.

You acknowledge and agree that, to the fullest extent permitted by law, any risks associated with your access to and use of the Website, services provided via the Website, or any interactions with Incharz’s personnel, whether online or in person, are solely your responsibility. Incharz and any other parties involved in creating, producing, or delivering the Website will not be liable for any incidental, special, exemplary, or consequential damages, including lost profits, loss of data or goodwill, service interruption, computer damage, system failure, or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with these Terms or the use of the Website. In no event will Incharz’s aggregate liability arising from these Terms and your use of the Website exceed the amounts you have paid via the Website, including charges for services provided and/or any other applicable charges.

You agree to release, defend (at Incharz’s option), indemnify, and hold Incharz and its affiliates and subsidiaries, including its officers, directors, employees, and agents, harmless from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your breach of these Terms or our Policies, improper use of the Website, or breach of any laws, regulations, or third-party rights.

Both you and Incharz mutually agree that any disputes arising from these Terms or related to the use of the Website will be settled by arbitration under the Arbitration and Conciliation Act, 1996 (as applicable in India and as amended from time to time). However, certain claims, such as those related to infringement of intellectual property rights or seeking emergency injunctive relief, may be brought in a court of competent jurisdiction.
  22. These Terms shall be governed by the laws of India, and the courts in New Delhi shall have exclusive jurisdiction over matters related to these Terms.
  23. We value your input and encourage you to share feedback, comments, and suggestions for improving the Website ("Feedback"). You can submit Feedback by emailing us, through the "Contact" section of the Website, or by other means of communication. Please note that any Feedback you provide is considered non-confidential and non-proprietary. By submitting Feedback, you grant us a non-exclusive, worldwide, royalty-free, irrevocable, sublicensable, perpetual license to use and publish those ideas and materials for any purpose, without compensating you.
  24. These Terms do not create any joint venture, partnership, employment, or agency relationship between you and Incharz through this Agreement or your use of the Website. Additionally, these Terms are not intended to grant any rights or remedies to any person other than the parties involved.
  25. If any provision of these Terms is deemed invalid or unenforceable, that specific provision will be deemed void, but it will not affect the validity and enforceability of the remaining provisions.
  26. Incharz's failure to enforce any right or provision in these Terms does not waive that right or provision unless acknowledged and agreed to by us in writing. The exercise of any remedy by either party under these Terms will not prejudice its other remedies under these Terms or otherwise permitted under law, except as expressly set forth herein.
  27. Accessing the Website from territories where it is illegal is prohibited, and Incharz assumes no responsibility for such access. Users are responsible for complying with applicable laws.
  28. Referral Policy: Referees can receive rewards for up to ten referrals only. Referral Credits have a limited validity, and the company may withdraw this offer without prior notice.
  29. Refund Policy

    We aim to deliver high-quality services to our customers. This refund policy outlines the circumstances under which we will issue refunds for charges made through the Incharz app.

    Eligibility for Refunds:

    Customers are eligible for a refund under the following circumstances:

    Charges made in error: If you were erroneously charged for a charging session or if the charging equipment malfunctioned, you are eligible for a refund. Services not provided as promised: If the charging station failed to deliver the promised service level (e.g., fast charging not available, station out of service), you are eligible for a refund.

    Unsatisfactory service: If you are dissatisfied with the service provided by the charging station or the Incharz app and believe a refund is warranted, you may be eligible for one.

    Requesting a Refund:

    To request a refund, contact our customer service team at info@incharz.com. Please provide your name, email address, phone number, and a detailed description of the issue experienced. Our team will review your request and determine eligibility.

    Processing of Refunds:

    Approved refunds will be processed within 7 business days. Refunds will be credited back to your Statiq account or refunded to the original payment method.

    Limitations:

    There are circumstances where refunds may not be issued:

    Extended usage: If you used the charging service for an extended period, we may issue a partial refund based on usage time.
    No error on our part: If the issue was not due to our error or if the charging station functioned properly, a refund may not be issued.

    Changes to the Refund Policy:

    We reserve the right to update this policy at any time. Updated policies will be posted on this page with the "Last Updated" date. Please review periodically to stay informed about our policies.
